These Terms and Conditions govern the sale of personalised and handmade products by Mumma Bears Cherished Memories ("We, "Us", "Our") through www.mummabears.com.

By placing an order, you agree to be legally bound by these Terms and Conditions.
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

Making a purchase and supplying information

If you wish to purchase any product or service made available through the service ("purchase"),
you may be asked to supply certain information relevant to your purchase including, without limitation,
your credit card number, the expiration date of your credit card, your billing address and your shipping
information. You represent and warrant that: (i) you have the legal right to use any credit card(s) or
other payment method(s) in connection with any purchase;  and that (ii) all information you supply
to us is true, correct and complete. You expressly agree that Mumma Bears Cherished Memories is not
responsible for damage arising from the submission of false or inaccurate information including incorrect delivery details. Order confirmation shall contain the following information:

  • Confirmation of the goods ordered including full details of the main characteristics of those goods;

  • Fully itemised pricing for the goods ordered including, where appropriate, taxes, delivery and other additional charges;

  • Confirmation of names and addresses provided at ordering.

By submitting such information, you grant us the right to provide the information to the third parties for purpose of facilitating the completion of purchases.
We are constantly updating our offerings of products and services on the service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the service and in our  advertising on other websites or marketing material. You expressly agree that any such offer of a product or service does not constitute a legal offer capable of attracting legal consequences.

We make every reasonable effort to ensure product descriptions, pricing and availability are accurate. However, errors may occasionally occur. We reserve the right to correct any errors and to cancel orders affected by such errors, providing a full refund where payment has been taken.

In order to offer you Klarna's payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with 

Termination and cancellation of orders

We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. You expressly agree that Mumma Bears Cherished Memories cannot accept any liability for loss or damage  arising out of such cancellation.

Under the Consumer Contracts Regulations 2013, Customers have the right to cancel within 14 days of placing an order. However this right does not apply to personalised or custom-made goods once production has commenced.
By placing an order for personalised or memorial products, you expressly consent to us beginning products before the end of the 14-day cancellation period and acknowledge that your right to cancel will be lost once production begins.

Where a collection kit has been dispatched prior to cancellation, the cost of the kit and delivery will be deducted from any refund. likewise if customer-supplied materials have already been received, the cost of returning those materials will be deducted from any refund.
Orders can not be cancelled by the customer after the 14 day cooling off period.

Use of the Mumma Bears Cherished Memories contact form to address your cancellation within 14 days is required. Add phrase "cancel" in email subject box to confirm your cancellation request, along with your order number. Contact form can be found

We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.

Product pricing, descriptions, availability and quality

Whilst every reasonable effort has been made to ensure that all graphical representation and descriptions of goods available fromus correspond to the actual goods, we are not responsible for variations from such descriptions. The nature of handcrafted and engraved jewellery means that each individual piece is unique and images shown on the website are examples only. This does not exclude our liability for mistakes due to negligence on our part and refers only to minor variations of the correct goods, not different goods altogether.
Where appropriate, you may be required to select the required size, model, colour, number and/or other features of the goods that you are purchasing.

We neither represent nor warrant that goods will be available. Stock indications are not provided on the website. If a product is unavailable after purchase, we will contact you promptly for a resolution.

We reserve the right to change prices and alter or remove any special offers as necessary. All pricing information is reviewed and updated every 24 hours.

All of our finished products are crafted and not machine made. The nature of handmade items means that no piece may be without any minor imperfections or faint scratches. No two pieces will ever be exactly the same. Products and product designs can be updated at any time, please read the product description carefully.

Gift vouchers / Gift cards

Gift vouchers or gift cards are valid for 24 months from the date of purchase and may be redeemed against any product or service on the website. Once expired, vouchers are non-refundable and cannot be extended or reissued. Please keep your voucher safe as they are required for redemption. redeemed.

Risk of loss

All items including sentimental inclusions, clothing, material or any thing sent to us,  are at the customers risk. Mumma Bears Cherished Memories is accepts no liability for loss or damage to these items while in transit or in our possession. This includes loss or damage due to fire, theft, or negligence. Customers are strongly advised to send any items via Royal Mail Special Delivery which is 24 hours tracked, signed for and fully insured up to £750.

Non- Delivery of goods to and from us


Within 24 hours of dispatched you will receive a dispatch confirmation email. If you have not received your parcel within 7 working days of dispatch, please contact us immediately.. If a parcel is returned due to a failed delivery, an additional charge will apply for re-dispatch. Please note that in the unlikely event of a missing parcel, we cannot offer a replacement or refund until the carrier formally declares the parcel lost,  which is currently 30 days from dispatch, 

All goods are considered delivered to the customer on receipt of a signature provided by the carrier. Mumma Bears Cherished Memories will not be responsible for any dispute over the signature provided by the carrier and the customer. All deliveries will require a signature upon delivery.

Returns Policy

Mumma Bears Cherished Memories strives to provide high-quality treasured gifts. As all  items are handmade and personalised we do not accept returns unless the item is incorrect or faulty. Returns are governed by these terms & conditions.

  1. Incorrect items on delivery - If you receive goods which do not match those that you ordered, for example, the wrong product or incorrect personalisation you should contact us within 7 calendar days to arrange a return. We will assess the goods and alleged discrepancy upon receipt and if we conclude (at our sole discretion, acting reasonably and in good faith) that the discrepancy is our fault, we will issue replacement goods at no additional cost to you.
     

  2. Faulty items on delivery - In the unlikely event that you believe your goods are faulty on receipt you must notify us within 7 calendar days of receiving your order to arrange a return. After inspection, if agreed by us to be faulty and through no fault of your own, you will be given the option of having the goods replaced with those ordered (if available). Replacements will be issued upon our receipt of the retuned goods. Goods must be returned in their original condition with all packaging and documentation. The packaging does not need to be unopened. Returned goods should be received by us within 14 calendar days of you receiving your goods.
     

  3. Goods damaged in transit - If goods are damaged in transit and the damage is apparent on delivery, you should sign any applicable delivery note to the effect that the goods have been damaged. Please take photographic evidence of the broken or damaged packaging. 
    To return the damaged goods please contact us within 7 calendar days. Replacements will be issued upon our receipt of the returned goods.

We take great care in creating, checking and photographing every item before dispatch. 

What is not considered a fault

  • General wear and tear 

  • Accidental damage or misuse

  • Damage caused by improper care and not following recommended care instructions

  • Natural minor variations due to the handmade nature of the items

  • Slight colour variations due to screen differences

  • Holes in fabric along stitch line due to underlying condition of clothing, like thinning fabric, fabric weakness due to age or amount of times warn
    and washed, stains or marks already on clothing or faded areas on clothing, etc. 

  • Pattern placement differences

  • Logo positioning

  • Seams repositioned for structural reasons

  • fabric sections reinforced internally

  • Reinforcement stitching 

  • Minor seam shaping changes to support structure.

  • Settling of stuffing over time

  • Natural compression from cuddling or display

  • Fabric relaxing

Customer supplied materials or inclusions

Customers confirm that they have the legal right to provide any clothing, materials or inclusions sent to us for use in creating our memorial items.
We do not claim ownership of customer-supplied garments or inclusions. However the final handmade design and construction of the finished product once created remains the intellectual property of Mumma Bears Cherished Memories.

Photographing, Marketing and Social Media

We reserve the right to photograph completed items for inclusion in our portfolio, website and marketing materials including Social Media Platforms. If a customer does not wish for their item to be photographed for marketing they must provide a written request at the time of ordering or when sending inclusions or garments to us. 
 

Governing Law

These Terms and Conditions, and any separate agreements whereby we provide services to you, shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales. Each Party irrevocably agrees to submit to the jurisdiction of these courts.

Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms, the parties agree first to attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved amicably it will be governed by and subject to the laws of England and Wales, and any legal action will take place in the courts of England and Wales.
